The Stop Aston Pointe Legal Fund has been established to help cover the costs of legal representation and related expenses associated with protecting the interests of our community.
Donated funds will be used for purposes including, but not limited to:
Attorney retainers and legal fees
Maryland Public Information Act (MPIA) requests and document retrieval costs
Expert review and consultation, if needed
Other reasonable expenses directly related to the legal effort
Legal Representation
We have retained Grant Geil of G. Macy Nelson, an attorney whose practice focuses on land use and environmental law.
Estimated Costs
The initial legal retainer is $5,000. Depending on the legal strategy pursued, total legal costs could reach approximately $30,000. If litigation becomes necessary and the matter proceeds through the court system, total legal expenses could exceed $100,000.
Fund Management
All donations will be deposited into a separate bank account established exclusively for the Aston Pointe Legal Fund. The fund's treasurer is Karen Selvage, who will oversee the receipt and disbursement of funds for approved legal expenses.
Transparency
Our goal is to conduct this effort with openness, accountability, and transparency. We intend to provide periodic updates regarding the progress of the legal effort and general financial reporting to the extent practical.
At the same time, contributors should understand that certain information cannot be publicly disclosed. Legal strategy, attorney-client communications, privileged documents, attorney work product, and other sensitive matters may remain confidential to protect the effectiveness of the legal effort and to comply with applicable legal and ethical obligations.
Use of Funds
All funds will be used solely to support this legal effort and related expenses.
If, after the legal matter has concluded or the effort is discontinued, funds remain in the account after all outstanding legal and related obligations have been satisfied, the remaining balance will be donated to an organization established to continue the efforts of the Stop Aston Pointe initiative. If no such organization exists at that time, the remaining funds will be donated to the Fair Hill Nature Center. Contributors acknowledge and agree to this intended disposition of any remaining funds by making a voluntary donation.
Tax Status
This legal fund is not a charitable organization, and contributions are not tax-deductible unless otherwise permitted by applicable law.
